FAQs

Below are some common FAQ's which business owners and employers ask about asbestos surveys

  • Do I need to conduct an asbestos survey in my workplace?

Yes, if your workplace was built before the year 2000, you are legally required to have an asbestos survey to check for the presence of asbestos-containing materials (ACMs). Under the Health and Safety at Work Act and the Control of Asbestos Regulations 2012, employers must manage any risks associated with asbestos and ensure the health and safety of employees. An asbestos survey helps identify any potential hazards and ensures compliance with UK regulations.

  • What are my responsibilities as an employer regarding asbestos management?

As an employer, you are legally required to protect employees from exposure to asbestos. This includes conducting an asbestos survey, maintaining an asbestos management plan, and ensuring that employees are informed about the potential risks. If asbestos is found, you must ensure its safe management and removal by licensed professionals. Employees must also receive adequate training if they could be exposed to asbestos in their roles.

  • What should I do if I discover asbestos in my workplace?

IIf you discover asbestos in your workplace, do not disturb it. If the asbestos-containing material is intact and in good condition, it generally does not pose a risk. However, if it's damaged or in a location where it could be disturbed, you must immediately contact a licensed asbestos removal company. They will assess the situation and safely remove the asbestos, following all necessary legal and health and safety guidelines.

  • How can I prevent employee exposure to asbestos during renovations or repairs?

During renovations or repairs, there is a higher risk of disturbing asbestos-containing materials. To prevent employee exposure, you should:

Have an asbestos survey conducted before any work begins.

Use licensed asbestos removal contractors to handle the removal of any ACMs.

Ensure that employees working in areas that may contain asbestos are fully trained and provided with the necessary protective equipment.

Set up controlled work zones with proper containment and ventilation to prevent asbestos fibres from spreading.

  • What penalties could my business face if I don’t manage asbestos correctly?

Failing to properly manage asbestos in the workplace can lead to severe penalties, including heavy fines and potential imprisonment. Under the Control of Asbestos Regulations 2012, employers have a legal duty to protect workers from asbestos exposure. Non-compliance can result in enforcement actions by the Health and Safety Executive (HSE), as well as significant harm to your employees' health. In extreme cases, this could lead to civil claims or legal proceedings if an employee suffers from asbestos-related diseases due to neglect. In the UK, there is no legal requirement for homeowners to have an asbestos survey before selling their property, but it’s advisable to conduct one if your house was built before 2000. An asbestos survey can provide potential buyers with important information regarding the presence of asbestos, which could impact the sale. If asbestos is found, you can also take necessary precautions for its safe removal and disposal before selling.
